Terms and Conditions
Definitions
1. "Booking Form" means the form relating to the booking or re-booking of the Participant for a Term as set out at the booking stage of the website
2. "Carer" means the person who attends the class with the Participant and is responsible for their welfare
3. "Class(es)" means a Perfect10 class described on the Booking Form
4. "Coach" means the individual engaged by PERFECT10 to teach Classes. Whilst every effort will be taken to maintain the consistency of the Coaches during the Term Perfect10 retains the right to retain the right to change the coaching staff where necessary
5. "Fees" means the value chargeable including VAT to attend Classes for a Term, as specified on the Booking Form
6. "Parent" means a parent or legal guardian of the Participant who will be responsible for the payment of the Fees and who is the contracting party to this contract and who shall (if the Carer is not the Parent) be responsible for compliance with these Terms & Conditions by the Carer
7. "Participant" means the child who is attending or who is booked on to a Perfect10 Class who details are specified by the Parent or Carer on the Booking Form
8. "Premises" means the premises where the Classes take place
9. Perfect10 , as named on the Booking Form, the company or person with whom you have entered into this contract in respect of the provision of classes and Perfect10.
10."Term" means the agreed dates on the Booking Form.
11."Terms & Conditions" means the terms and conditions set out in this document and any special terms and conditions agreed in writing by Perfect10 and the Parent
12."Website" means the website at perfect10.class4kids.co.uk
Acceptance
1. All agreements and issues relating to the teaching of the Classes by Perfect10 to the Participant and the on-going communication with Coaches, back office staff and Perfect10 head office are subject to the Terms & Conditions to the exclusion of all others.
2. No variation or addition to the Terms & Conditions shall be binding unless agreed in writing by Perfect10 and the Parent.
3. These Terms & Conditions shall be deemed to be accepted by the Parent and the Carer once the box is ticked on the Booking Form and confirmation of payment of Fees has been received by Perfect10.
4. Perfect10 may cancel this contract at any time before the Participant commences a Term, for any reason whatsoever. Perfect10 shall not be responsible for any loss or damage whatsoever arising from such cancellation but will refund Fees paid for the remaining Classes in the Term.
5. In the event that a class needs to be cancelled due to school / religious holidays, school closure or poor weather, Perfect10 will endeavour to provide a replacement class. In such a situation, no alternative financial refund is available.
6. Bookings for all classes are NON-TRANSFERABLE. A registered and booked participant's place in a class cannot be offered to another child whether they are registered with Perfect10 or not.
Confidentiality
1. By agreeing to these Terms & Conditions the Parent and/or Carer agrees not to share any aspects of Perfect10 programme with a third party who may be involved in a business that operates in the same market as Perfect10. The Parent and/or Carer will not be involved directly or indirectly with such a company.
2. The Parent and/or Carer will not take, replicate or use any Perfect10 material directly or indirectly for his/her own use or for use by any third party
Parent/Carer Obligation
1. The Parent warrants that the information provided on the Booking Form is accurate and up to date in all respects at the point of booking. Any changes will be sent by the Parent and/or Carer to Perfect10 immediately.
2. It is the Parent and/or Carer's responsibility to inform Perfect10 of any special medical conditions at the point of booking. This includes behavioural disorders.
3. The Participant and/or Parent and/or Carer must not attend any Class whilst suffering from any contagious disease or anything similar thereto.
4. Immediately before and after all classes the Parent and/or Carer agrees and accepts the sole responsibility, general conduct and care for the Participant whilst on the Premises.
5. Perfect10 requires the parent or carer to leave the premises whilst their child attends our class (with exception for serious medical conditions) and to collect them on time at the end of the class.
6. Arriving Late: If parents/carers arrive more than 15 minutes late to pick up their child after a class, they will be charged for the coaches extra waiting time.
7. Perfect10 shall have the sole right to exclude the Participant and/or Parent and/or Carer either permanently or for such period as Perfect10 shall (in its entire discretion) determine if deemed necessary for the safety and well-being of other participants or parents or carers.
8. Participants not adequately toilet trained are not accepted in any of our classes.
9. All Rec Plus, Intermediate and Advanced participants attending must be members of British Gymnastics.
Limitation of Liability
1. The Parent and/or Carer agrees that any claim made against Perfect10 will be made in writing within 30 days of the incident taking place and failure to report in writing within this time will negate any such claim.
2. The maximum aggregate liability for Perfect10 to the Participant, Parent and/or Carer will not exceed the Fees.
3. Neither Perfect10 nor any Coach, coaches assistant nor any employee, agent or other representative accepts responsibility in respect of loss, damage or expense incurred by a Participant, Parent and/or Carer arising directly or indirectly or in any way connected with the attendance of the Participant, Parent and/or Carer at Classes (or any Class) or any other act or omission on the part of Perfect10, its Coaches, coaches assistants, employees, agents and/or representatives.
4. All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or excluded liability for death or personal injury caused by the negligence of Perfect10 , its coaches, coaching assistants, employees, agents and/or representatives or affects the statutory rights of the parent or Participant.
5. Children attending a waiting class before or after our classes are the responsibility of the providers of the waiting class and are not the responsibility of Perfect10.
Fees & Payment
1. The Parent shall pay the Fees inclusive of VAT for the Term to Perfect10 prior to the Participant commencing a Term.
2. Any statutory rights remain unaffected under English law. In accordance with the provisions of the Consumer Protection Regulations 2000, consumers have the right to withdraw from this transaction under the provision of a cooling off period of seven working days, starting from when the booking is made. After that period we will refund to the sum of 75% of the total booking if notice of cancellation is received in writing (email permitted) more than 14 days before the start of the course. If notice of cancellation is received within 14 days before the start of the course, the customer does not qualify for a refund of any amount.
3. Changing sessions: If you have booked for one our classes, but would prefer to change to another Perfect10 class running during the same term there is a £15 + VAT admin charge.
4. The 'Priority booking period' is for children already attending that particular class. If someone has booked a class or queue jumped Perfect10 retains the right to cancel their booking.
5. If a session has been booked and the participant is unable to attend, Perfect10 will not refund or offer an alternative session.
General
1. By agreeing to these terms and conditions the Parent consents that the data provided
2. PRIVACY POLICY Perfect10 does not store nor intend to store any financial details (credit or debit card numbers).
3. The Parent shall indemnify and keep indemnified Perfect10 against all loss (including loss of profit), liability, cost and expenses which Perfect10 may incur directly or indirectly as a consequence of any action or inaction of the Parent, Carer and/or Participant.
4. Any notices to be sent by either party to the other shall be sent by pre-paid recorded delivery or hand delivered to the address of the relevant party and shall be deemed to have been received by the addressee within 48 hours of posting or immediately if hand delivered.
5. The failure by either party to enforce at any time or for any period any one or more of the obligations arising under this contract shall not be a waiver of them or of the right at any time subsequently to enforce any or all of such obligations.
6. These terms and conditions constitute the entire agreement between the parties hereto and supersedes prior agreements and understandings between the parties.
7. This contract shall be governed by the laws of England and Northern Ireland.
Class Rules & Clothing
Please arrive for your lesson on time. The warm up at the beginning is essential to the class: it will help to prevent injuries and prepare your child mentally and physically for the session.
- No jewelry (including stud earrings)
- Long hair must be tied back securely with a band
- No jeans or long trousers
- No socks or tights
Access to Classes
Children may only access our classes if payment has been made in advance. We are unable to allow children to attend classes without payment and/or a signed permission form. This could invalidate our insurance protection policy for your child and us.
Clothing
For safety and comfort, appropriate clothing must be worn for all sessions, as detailed below.
Gymnastics
Girls: leotards (plus shorts if necessary - no tights). Boys: T-shirts or leotards and shorts. Bare feet.
Other information
Photography
Photography is NOT permitted at our classes. Once a year we have a display at which you are allowed to take photos of your child.
Food / Drink
Food is not permitted in the hall. Children may bring a plastic water bottle into the hall. If you child would like a post school/pre-class snack we would suggest cereal bar, dried or fresh fruit. Children eating any more than this just before the class risk feeling sick or getting stomach cramp during the session.
Medical Needs
Please make sure you have added all relevant special medical information on registration. Please do email extra information to us perfect10GC@gmail.com We would strongly suggest that you mention all relevant needs to the head coach at the beginning of your child's term. We do our best to include ALL children in our sessions. If your child is Autistic, Epileptic or has Diabetes, you are welcome to stay for the duration of their class.
Pick up
Please pick up your children from the main door to the hall. For safety reasons we cannot let young children out of the gym without a parent or guardian to meet them.
If parents/carers arrive more than 15 minutes after the end of the session, they will be charged for the coaches extra time.
Drop Off
We encourage all parents to stop and drop. Settling in is often much easier if the parent can swiftly leave and we can get on with the coaching. An exception to this rule is made for medical / special needs (see Medical Needs). Once a term we hold an open session where parents can stay to watch their children.
